Legal Status Update – January 2026

Pistol Brace Federal Status

Federal: Legal as of 2025. ATF 2023 rule vacated by federal courts. Braced pistols are NOT SBRs at federal level.

State: Some states (CA, NY, NJ, etc.) have additional restrictions. Always verify local laws.

NFA Tax Stamp Changes

Federal: Effective January 1, 2026: $0 tax stamp for SBRs, suppressors, SBSs, and AOWs. NFA process still required.

State: State bans on NFA items remain in effect regardless of federal tax changes.

AR Pistol Definition

Federal: Barrel under 16", OAL under 26", built from virgin receiver or pistol-designated lower.

State: Cannot convert a rifle to a pistol. Must be built as pistol from start.
