The statute in practice

Delaware Law in Detail

Delaware Code title 11, section 1468 defines a large-capacity magazine as a feeding device that accepts, or can readily be converted to hold, more than 17 rounds. An attached .22-caliber rimfire tubular device is excluded, and a removable floorplate alone is not enough to prove ready convertibility.

Section 1469 supplies exemptions for listed government and law-enforcement personnel, qualified retired officers, holders of a current Delaware concealed-carry permit, certain dealer transactions, permanently inoperable devices, and devices permanently modified to 17 rounds or fewer.

What it means for you

Practical Notes

The concealed-carry exception is keyed to a current permit issued by the Delaware Superior Court under section 1441. It should not be assumed to follow from an out-of-state carry credential.
