Virginia Magazine Limit: No Current State Cap

Virginia Code section 18.2-309.1, added by the 2026 acts on SB 749 and HB 217 (chapters 1106 and 1107), makes it a Class 1 misdemeanor to import, sell, barter, transfer, or purchase a large capacity ammunition feeding device, defined as a device that has a capacity of, or can be readily restored or converted to accept, more than 15 rounds. The section has no possession offense, and it exempts import by a person who lawfully purchased and possessed the device before July 1, 2026, as well as that person's sale or transfer of it to a licensed dealer or an out-of-state recipient.

Official Hanover County guidance reports that the provisions were scheduled for July 1, 2026 and are blocked by injunctions from two Virginia circuit courts while constitutional challenges proceed. On July 7, 2026, the Washington County Circuit Court expanded its preliminary injunction to apply statewide, effective July 21, 2026.

There is no federal magazine capacity limit; the 1994 federal assault weapons ban expired in 2004.
