Oregon Magazine Limit: No Current State Cap

Measure 114 added a definition of a large-capacity magazine to ORS chapter 166: a fixed or detachable feeding device that has an overall capacity of, or can be readily restored, changed, or converted to accept, more than 10 rounds. It excludes a device permanently altered so it cannot accept more than 10 rounds, an attached .22 caliber rimfire tubular device, and a tubular feeding device in a lever-action firearm.

The measure has never taken effect. The Oregon Court of Appeals reversed the trial court's judgment and held the measure facially constitutional in March 2025, and the challenge is pending before the Oregon Supreme Court, which had not ruled as of October 20, 2026. HB 4145 (Oregon Laws 2026, chapter 120), effective April 7, 2026, provides that the magazine provisions in ORS 166.355 apply only to manufacture, importation, possession, use, purchase, sale, or transfer occurring on or after January 1, 2028, and states that it does not affect the pending Supreme Court proceedings.

There is no federal magazine capacity limit; the 1994 federal assault weapons ban expired in 2004.
