Montana Magazine Limit: No Current State Cap

Montana Code section 45-8-351 bars a county, city, town, consolidated local government, or other local government unit from prohibiting, registering, taxing, licensing, or regulating the purchase, sale or other transfer, ownership, possession, transportation, use, or unconcealed carrying of any weapon. It allows a city or town to regulate the discharge of rifles, shotguns, and handguns for public safety, and allows local governments to prevent and suppress the carrying of unpermitted concealed weapons and the carrying of unconcealed weapons to publicly owned and occupied buildings.

There is no federal magazine capacity limit; the 1994 federal assault weapons ban expired in 2004.
